1. Agreement to Terms

By accessing our website at tourtochichenitza.com or booking any tour through Maya Explorer Tours, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Tour Bookings

When you book a tour with us, you agree to the following:

• All bookings are subject to availability and confirmation by Maya Explorer Tours.
• You must provide accurate and complete information, including the number of travelers, names, and contact details.
• The lead booker must be at least 18 years of age.
• Prices are quoted in USD and are subject to change without notice until a booking is confirmed.
• A booking is confirmed once you receive a written confirmation via email or WhatsApp.

3. Payment Terms

Payment is arranged directly with a Maya Explorer Tours coordinator over WhatsApp after your quote is confirmed. Accepted methods (bank transfer, secure card payment link, or cash on tour day for select tours) are agreed in writing in your booking thread before you pay. All prices are quoted in USD and include applicable taxes unless stated otherwise.

Official channels: any payment or booking request that does not come from info@tourtochichenitza.com or WhatsApp +1 (787) 978-4193 is not from Maya Explorer Tours. Do not send funds to any other account or number.

4. Cancellation & Refund Policy

Cancellations and refunds are governed by our Cancellation Policy. In summary: free cancellation with full refund if cancelled more than 48 hours before the tour; 50% refund within 48 hours; no refund for no-shows.

5. Tour Participation

• Travelers must arrive at the designated pickup point on time. Maya Explorer Tours is not responsible for missed pickups due to late arrival.
• We reserve the right to refuse service to anyone who is intoxicated, disruptive, or poses a safety risk to others.
• Travelers must follow all instructions given by tour guides, especially regarding safety at archaeological sites and cenotes.
• Minimum age requirements may apply to certain tours (e.g., cenote swimming, adventure activities).

6. Health & Safety

Travelers are responsible for ensuring they are physically fit to participate in the tour booked. If you have any medical conditions, allergies, or mobility limitations, please inform us at the time of booking. We recommend travel insurance for all participants.

7. Liability

Maya Explorer Tours acts as a curator and coordinator between travelers and vetted local service providers (transportation, venues, restaurants). While we personally select our partners, we are not liable for any injury, loss, or damage arising from third-party services. Our total liability shall not exceed the amount paid for the tour.

8. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our control, including but not limited to: natural disasters, severe weather, pandemics, government actions, strikes, or civil unrest. In such cases, we will offer a full refund or rebooking at no additional cost.

9. Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Maya Explorer Tours and is protected by copyright law. You may not reproduce, distribute, or use any content without prior written consent.

10. Modifications to Tours

We reserve the right to modify itineraries due to weather, road conditions, site closures, or safety concerns. Any changes will be communicated as soon as possible, and suitable alternatives will be provided.

11. Governing Law

These terms are governed by the laws of Mexico. Any disputes shall be resolved in the courts of Cancun, Quintana Roo, Mexico.
